In August 2008, the WAPC approved a subdivision at Lakeview Street, Mariginiup which allowed for the retention of a market garden and a single large lot for rural purposes in accordance with the City of Wanneroo District Planning Scheme 2.  Approval for the creation of two lots (83.11 ha and 8.09 ha) does not pre-empt planning for possible urban development in the area.

The WAPC’s policy for the area is set out in The future of east Wanneroo: land use and water management in the context of Network City, published in August 2007.

Any future urbanisation in east Wanneroo is predicated on the establishment of an alternative precinct to replace the existing agricultural and horticultural uses in east Wanneroo.  The Department of Water, through an inter-agency taskforce, will be developing a comprehensive strategy for the management of the Gnangara mound and a horticulture precinct feasibility study.  The City of Wanneroo will prepare plans for the rural areas along Wanneroo Road and in Nowergup and Carabooda. 

Any future urbanisation in east Wanneroo also depends on the completion of comprehensive land use planning integrated with plans for the north-west corridor.  The Department for Planning and Infrastructure and its partners will define a sustainable urban structure incorporating road and public transport networks and strategies, activity centres and corridors, population targets and job targets.  To assist in land use transition, a technical working group is being formed to guide the preparation of a sub-regional structure plan as envisaged in The future of east Wanneroo.

The WAPC was satisfied that the division of a large rural site into two lots will not prejudice strategic planning in east Wanneroo and could be approved as an exception to the general policy against fragmentation of land prior to comprehensive strategic planning.  This case does not set a precedent for further subdivisions in the area.
